Conditions of Business
(Effective August 15, 2010)

Conditions & General Information: The conditions below form the basis of any contract between you and InterGolf Vacations (the Company). When you contact the Company to book your tour, you appoint them to act as your agent to obtain the requested services for you. When they have done so, and you have confirmed the booking and paid the deposit, they will accept responsibility for providing your vacation from that point onwards. No employee or representative of the Company has the authority to change these conditions or information. This Agreement shall be governed by the substantive laws of the State of Georgia. The parties irrevocably agree that any judicial proceedings relating to this agreement will be filed in a court of competent jurisdiction within Fulton County, Georgia.

Deposit & Final Payment: In order to confirm a booking a non-refundable deposit of 30% of agreed land trip cost per person (subject to a minimum deposit of $1000 per person) is required. It may be paid by check, direct deposit or by incurring an additional 3% charge, a credit card – American Express, MasterCard, VISA or Discover may be used. Bookings are only accepted subject to the availability of required tour services such as accommodations and golf starting times. Payment of balances and cancellation penalty are as outlined below.

Travel Protection Plan including Exchange Rate Guarantee: InterGolf Vacations recommends that you have luggage, accident and trip cancellation insurance. InterGolf Vacations is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness. It is important for your own self-interest and protection that you make certain you have adequate coverage. Check with your insurance company or travel agent.

InterGolf Vacations offers the option to purchase a package to include both a Travel Protection Plan and an Exchange Rate Guarantee. You may learn more about the InterGolf Vacations Travel Protection Plan by visiting our website at www.InterGolf Vacations.com/protection. Unless declined, InterGolf Vacations clients will be enrolled with World Access Service Corp. InterGolf Vacations act as an agent of World Access Service Corp. The details of the Plan are set out below, or simply visit the Travel Protection Plan section of our website. Travel Protection Plan is available only to Residents of the USA or Canada and is subject to a maximum trip value of $20,000 per person. In addition, this option package also provides protection from a weakening United States Dollar by guaranteeing that no surcharge will be levied no matter what happens in the world currency markets after your deposit has been received. If the Travel Protection Plan including Exchange Rate Guarantee option is declined then an exchange rate surcharge may be applied on your whole trip value. This surcharge will be based on the H.10 weekly Foreign Exchange Rates table as published by the Federal Reserve and which is currently available at http://www.federalreserve.gov/releases/h10/Current/. The surcharge to be applied will be calculated by the movement in these published rates from the daily rate on the date your deposit is received to the latest available Friday’s rate that has been published by the Federal Reserve as at the date your final balance is due. The rates used will be those for United Kingdom Pounds for trips to Great Britain and the EMU Members Euro for trips to Ireland. Where your trip involves both Great Britain and Ireland the currency rate used will be determined by InterGolf Vacations based on the higher cost component of the trip. The increase in the rate as expressed as a percentage of the rate value at the time your deposit is received will be applied to your full trip value where the calculated percentage as rounded up to two decimal places is 5.00% or more. The surcharge as rounded up to the nearest dollar will be notified to you on your final invoice and will be due at the final balance date. If the option to pay by credit card has been notified then the 3% charge for this payment method will also be applied to the surcharge and the revised total trip cost will be charged against the card details provided. As the Company limits its foreign exchange exposure from time to time there will be no refunds payable as a result of any exchange rate reductions and no surcharge will be applied when any reduction in rate occurs.

Travel Agents: The Company only accepts bookings directly from passengers and thus no commission will be paid to any travel agent or introducer of business.

Car Rental: On independent tours with a rental car, all drivers must be over 25 years of age, and under 65.

Air Travel: InterGolf Vacations does not offer airline tickets for travel on scheduled or other airlines and is therefore your responsibility as a separate item out with the travel package, and may carry change and cancellation penalties as specified by the carrier.

Documentation: For US citizens, a current passport is required for travel to European destinations. Citizens of other countries should check with the appropriate Embassy.

Changes: An administrative fee of $100.00 per change per person will be charged for changes requested by you after your deposit has been received and confirmation issued. In all cases, changes cannot be made less than 60 days before travel.

Name Changes: In the event you wish to change the name of one of the golfers previously confirmed on a trip, the following per person charges shall apply; more than 60 days before departure – a charge of $100 plus any applicable non-refundable deposits paid to golf clubs which prohibit the transfer of deposits, 60 – 30 days before departure a charge of $400 plus any applicable non-refundable payments made to golf clubs which prohibit transfer of same; less than 30 days before departure a charge of $800 plus any applicable non refundable payments made to golf clubs which prohibit transfer of same.

Cancellations: Notification of cancellation by a client must be forwarded in writing to InterGolf Vacations. Cancellation charges are as stated on the cancellation charges schedule. No refund will be made for unused portions of a travel package.

Golf Handicaps: A number of golf clubs require visitors to show handicap cards. While this is not particularly common we strongly recommend you travel with a handicap card, and accept no responsibility if you do not and are subsequently denied golf. Certain clubs also place maximum handicap restrictions on visitors. If your handicap is greater than 24 (men) or 36 (ladies) please notify us in order we can discuss which clubs may have relevant restrictions. Also, please note that InterGolf Vacations can accept no responsibility for the playing conditions of any golf courses, including changes caused by course maintenance or weather conditions.

Responsibility: InterGolf Vacations, as the tour operator, and its selling agents act only as agents in securing and booking the hotel accommodations and other land tour services provided as others as independent contractors. InterGolf Vacations, it’s selling agents or the specified air carriers assume and accept no liability for injury, loss, damage, accident, delay, changes or inconvenience caused by: any force majeure - health risks - reason of war or threat of war – riots - civil strife - terrorist activity - industrial disputes – acts, omission, neglect, delay or default of any person engaged in providing any tour services including transportation and accommodation - technical problems to transport - closure or congestion of airports or ports - building work - extended hotel closure - cancellations or changes of schedules by airlines - interruption or failure of public utilities outside the control of the hotel and similar events beyond our control, including storms, volcanic eruptions, tempests and hurricanes.

If any tour service or its reasonable equivalent is not provided due to events beyond the reasonable control of InterGolf Vacations, the company will make an appropriate refund of that portion of the tour price covering the undelivered tour service, but it is understood that InterGolf Vacations shall have no other or further responsibility or liability either for the accuracy of any representation or the non provision of any tour services.

Transport by aircraft, rail, ship or coach will depend on the conditions of carriage of the relevant carrier. These conditions of carriage may limit or exclude the carrier’s liability to you under international law (such as the Warsaw Convention). The responsibility and liability of the specified air carriers respecting their performance of air transportation services are limited by and subject to the conditions of contract in the passenger ticket, the rules contained in tariffs on file with U.S. Department of Transportation (available for inspection on request), and applicable provisions of law and treaty.

InterGolf Vacations is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness on any vehicle or at any place throughout the tour.

InterGolf Vacations reserves the right to cancel a tour if circumstances so require. In the event of such, InterGolf Vacations will make a full refund to travelers of all payments received in respect of the tour. Such a refund of payments will be the full extent of InterGolf Vacations’ obligation and liability to travelers. This Agreement shall be governed by the substantive laws of the State of Georgia. The parties irrevocably agree that any judicial proceedings relating to this agreement will be filed in a court of competent jurisdiction within Fulton County, Georgia.

Caddies: As a free service to clients, InterGolf Vacations will request caddies for those who wish them, however they cannot be guaranteed. They may only be requested for the entire duration of a trip, and not for individual rounds. If you request caddies, InterGolf Vacations will forward a request for caddies in advance of your visit. The golf clubs will make every effort to secure caddies but they are neither employed by the golf clubs nor by InterGolf Vacations. Please consult with your Golf Travel Specialist at InterGolf Vacations regarding the likelihood of accessing a caddie on your selected courses. In general the demand for caddies at most courses exceeds the availability. If a caddie is secured for you, the caddie master or another club official will inform you of the caddie charge and tipping policy.

Travel Protection Plan is available only to Residents of the USA or Canada.
